New Regulations on AIRE Registration

The 2024 Legge di Bilancio has introduced significant changes regarding registration with the Registry of Italians Residing Abroad (AIRE). While emphasizing that registration with AIRE is a specific duty of compatriots residing abroad and a fundamental prerequisite for access to consular services, it is noted that Article 1, paragraph 242, of Law No. 213 of December 30, 2023, has strengthened measures for those who relocate their residence abroad without proceeding with AIRE registration. According to the amendment to Article 11 of Law 1228/1954, Italian municipalities are now authorized to impose pecuniary sanctions ranging from 200 Euros to a maximum of 1,000 Euros for each year of failure to register with AIRE, with a maximum limit of 5 years.

 

Furthermore, Article 1, paragraph 243, of the Legge di Bilancio requires public administrations to report to the municipality of registration any element indicating the residence abroad, even only in fact, of Italian citizens. The municipality of registration must communicate this information to the Revenue Agency, thus enabling tax checks.
